A four-year-long court fight against Google and Yahoo for displaying gambling ads in their search results has been thrown out of by a top judge.

Richard Kramer granted both companies and their fellow search engine operators “immunity from liability” based on the federal Communications Decency Act (CDA).

Questions

Section 230 of the CDA says operators of Internet services are not to be held liable for words of third parties who use their services — including Google’s own AdWords programme.

And Judge Kramer ruled that because Google and Yahoo had already stopped accepting gambling ads in the U.S. on their own behalf, there was no reason to issue an injunction.

However the California Superior Court decision still leaves a question mark over whether the gambling sites that advertise on Google and Yahoo face legal action.

Settlement

The lawsuit dates back to 2004 when Google and Yahoo were sued by two California residents who reportedly lost nearly £70,000 gambling online.

In 2007, Google and Yahoo and rivals Microsoft paid £21.2 MILLION to settle with the US Justice Department for promoting of gambling sites within the U.S.
